Legal Question in Civil Rights Law in California

In the state of California is it legal for an 18 year old and a 15 year old to date, including kissing, holding hands, hugging and touching with parental concent from the minors' parent?

There are two categories that might apply. It is not statuutopry rape from the facts you supply, but you could be charges with contributing to the delinquence of a minor, in that what you list is sexual behavior that causes sexual desires and leads to intercourse. Consent from the parents is basically irrelevant. If there is only 1-2 years in age dilfference, the authorities might not claim rape, but you are an adult for most purposes dealing with someone 3 years younger. I assume you are a male, so there would be an impression of greater misconduct and your taking advantage of her.

Even if no criminal charges result, what you are doing is stupid. Why rob the minor of their chance ot grow up and experience her high school years with those her age? So you really believe she knows what she is doing? You will find very few people who believe you are not manipulating and taking advantage of her. If the parents or she get mad at your, they will allege statutory rape and you will spend a lot of money defending yourself and perhaps being branded for the rest of your life as a child molestor. Stop dating her, let her grow up, and if there really ils something between the two of you in three years you can begin dating again. Loving someone sometimes means staying away from them.
