Legal Question in Civil Rights Law in California

I dont want someone to talk to my 7yr old. He came and today said, he was told, 'your so sweet, too bad your mom's a b*%th.'. There has to be legal options before I become the defendant. She does not live here, just visits.

I am not sure why you are saying YOU might become a defendant. ? Consider a restraining order. Also, you should contact the police; talking to a child like this is wrong in so many ways. This person definitely needs to be separated from your child of 7yrs.

I don't know a judge that would give the person leniency.
