MP3 shared music for Personal Use - legal?

A friend has been threatened with disclosure to the authorities because he has recorded some shared music off the internet for personal use ''ala Nabster''. Can and will this be a problem for him? Just what authorities would handle this? Are these CDRs illegal to have in his possession?

Unless he is selling the CDs or somehow making a profit with them it is something authorities are very unlikely to pursue.
