Legal Question in Constitutional Law in California

Recently my husband has had a member of his ex wifes family retaliate making a police report saying he touched her inappropriately when she was a minor, these allegations are false tho and so far she has only made a police report. his ex wife was advised to not let my husband see his kids who are 14 and 12. but question is should we take any legal steps and should we worry about anybody coming after our 2 year old we currently have.

You should immediately consult with a criminal defense attorney in preparation for the possibility that further action may ensue. You should consider the possibility that DSS may come out to investigate the home and could seek to put your child in protective custody. You may want to consider alternative living arrangements if they take the charge seriously. Your child will need to be protected possibly living with relatives until the charges are abandoned. It may be that the ex wife merely wants to prevent the husband from visiting his children but you cannot be unprepared for the authorities taking this to the extreme.
