Legal Question in Construction Law in California

I am in disagreement with my contractor. The balance I owe him is 3000 +/- materials that each one purchsed according to the contract. He stated he is done and I disagree. I hired another contractor to finish and correct thing he failed to do the way I wanted. He is threatening to file a lien. We have been back and forth. He just offered he would take 1750 as final payment. If I take this offer, does that affect me filing suit to recover damages?

Yes. He will assert that it is a settlement. What would the point be anyway of paying him and then suing him to get it back? That makes no sense. Either settle with him or litigate.
