Legal Question in Construction Law in California

Is there an implied warranty in California regarding pool construction that applies to the buyer of a home whose pool was built 2 1/2 years before purchase? The express warranty might cover the problem but I, the buyer, was never told that I had to apply to have the warranty transferred to me. Thank you.

You can find a pretty good beginning introduction to California contractor warranties on line at http://www.professionalhomeinspection.net/pdf/contractor_law_1-4-10_yr.pdf

Basically, it tells you that the law requires a licensed contractor to provide one year, four year and ten year warranties. Each warranty covers fewer types of claims. You should be covered by the four and ten year warranties.

I'm pretty sure the warranties run with the property and are not wiped out by a sale to a new owner.
