Legal Question in Construction Law in California

Can a insurance company cancel a policy by a certified fax and no signature? A certified fax was sent stating certified fax, the conditions (payment) was meet of the fax prior to expiration date listed but the policy was canceled and additional (not prior requested) fees were automatically withdrawn after the expiration date. Upon starting up work several months later, policy was deemed canceled and much higher w/c rates were attached.

This seems rather sloppy and might not have been effective if you hadn't received the fax, but you did. Perhaps, however, you authorized fax communication to you from the insurance company in your application.......I'd review the application and the issued policy to see if there is any mention that they will send you important notices by facsimile.
