Legal Question in Construction Law in California

property liability

my nieghbor had a partioning wall

and the earth on my side sloped I

pulled permits exavated the earth on

my side built a real retaining wall on

my side and am in the process of

backfilling between there partioning

wall and my new wall. We had a

large rain strom and they also have a

patio attached to it. Both there patio

and wall came down and tumbled on

my property. I am trying to work

with them in this regards (i'll be

living next to them for years to

come) but dont know where I legally

stand. should I fix it? Offer money?

leave it to them? any advice on this

matter please. I dont want any

other problems with them

You've already got the problems; now fix it. Either resolve it yourself, or hire counsel to help you do so, trying to avoid being sued. Feel free to contact me for the legal help you'll need getting an effective and enforceable settlement agreement that protects you, or defending the lawsuit if there is no agreement possible, if the case is in SoCal.
