Legal Question in Construction Law in California

Can't get settlement payment

I sued a contractor 2.5 years ago and in

front of judge we settled on an

agreement where he'd pay a significant

portion of a new estimate to repair. Til

this day he is offering payment at

$100/mon, which we rejected. My

attorney isn't really being the bulldog I

need. What other options do I have?

Should I switch lawyers? I want to get

my settlement money and not go to

trial.

Re: Can't get settlement payment

Much depends on how the settlement was reached and how it was documented. If the settlement was placed "on the record", you might be able to go back into court and have the balance of the settlement entered as a judgment. If the contractor has an unpaid judgment against him related to a construction contract, you can report the judgment to the Contractor's State License Board and they will suspend the license.

You need to ask your attorney about your options and why he/she isn't working to get your money. If you need a further consultation, please contact my office.

Re: Can't get settlement payment

If the case was settled, how can there be a trial coming up? It sounds as if there was no settlement.

Odd that it was two years ago as well.

We are collection litigators and we enforce judgments. We would be happy to review your matter and provide a no charge consult.
