Legal Question in Construction Law in California

How can i sue my Carpenter/Framer

I had written into a contract with my not licensed Framer as i was doing homeowners contracting..he said that it will take him approx 5 weeks to two months to complete..it has now been almost 8 months and it's not even half way done and we completely finised paying him 5 months ago and he comes barely 2-3 X's a week and now we're lucky if he comes once a week..we are now going to get another framer to finish the job and pay him additional funds..what are my options as my original framer..can i sue him to get at least half of what we paid.

Under the current law, if your contractor is not licensed, you can sue him for a return of all monies paid to him. See California Business and Professions Code Section 7031.

I would first send him a letter confirming your agreement and telling him you will have to hire another framer due to his continuing breaches. This way, when you do sue him, he will not be able to claim he was never put on notice that you needed to have the job done more quickly.
