Legal Question in Consumer Law in California

An antiquities dealer who I had bought an artifact from offered to sell my piece on consignment. I shipped it to him back in January 2012. There was no formal consignment agreement, but I have his email to the effect that he received the item.

I didn't realize that he had filed for bankruptcy some time after my purchase, and his business phone numbers are no longer valid. He did give me his cell phone, and when I last spoke to him in September, he claimed he sold the piece and has been wating for the money, but won't tell me who bought it or when. He has not been able to provide any invoice relating to that sale.

I fear I may not get either the money or my artifact back.

What are my rights and how can I go about getting this issue resolved in my favor? Do I have a right to have him provide the number of the party who bought it, such that I, as owner, can contact them to validate this transaction and inquire about payment?

Can I file litigation against him, even though he has filed bankruptcy? He led me to believe he was still operating under his former business while in possession of my artifiact.

Thanks

Mike

You need to hire a bankruptcy attorney and proceed in bankruptcy court before it is too late.
