Legal Question in Consumer Law in California

Appliance replacement

Recently we needed to have the dishwasher replaced. The landlord says that we need to pay for the whole thing because it was our fault for breaking the dishwasher. I realize that I am responsible for a portion of the cost of replacing the dishwasher but am I on the hook for the entire cost?

Re: Appliance replacement

It depends. How old was the dishwasher? How did it break? Was it in good condition before it was broken?

Re: Appliance replacement

If you did nothing but use it in a normal manner, you owe nothing. If you did something out of the ordinary which caused it to break, you're on the hook . . . but only as to the amount of damage you caused, up to a maximum of the value of the dishwasher at the time you broke it - NOT REPLACEMENT COST.

Re: Appliance replacement

Read your lease. Did you abuse the washer or did it just die of wear and tear? If it broke down from normal use and the lease does not require that you pay for wear and tear, the landlord may owe for the replacement.
