Legal Question in Consumer Law in California

auto repair - shop broke car

Brief history:

I drove my Saab to a shop for a check up in the morning. In evening, the mechanic told me that he checked the car, did not find any major problems, but now the car would not start. Mechanic spent 2 weeks trying to find what went wrong and said that he could not find the problem. I towed my car to a Saab dealership. They told me that the engine was damaged by the previous mechanic and that the cause of damage was obvious to any mechanic who looks at the car. Repairs estimated at $6,000+

What should I do? The shop owner refuses to pay. Small claims court or 'regular' civil court? Is there something I need to do now to collect the necessary evidence?

Thanks

Re: auto repair - shop broke car

you will need a mechanic to testify re the damage done by the defendant. you can go small claims but you will be limited to $5000
