New Automobile contracts

We recently purchased a new Ford truck. We signed the papers on 5-13-02 and gave them our trade-in. They were to dealer trade the truck for us from another dealer in L.A. We signed the contract with that VIN# of the truck from L.A. We did not receive the truck and they told us they would get us another truck from another dealer (same truck different color) but now because they realized they gave us too much for the trade-in the price has gone up and we have to sign a new contract and pay more for the same truck type. My question is since the VIN# of the truck they never secured from the L.A. dealer is on our contract are they responsible to give us the same deal for the other truck. We heard that it is illegal to sell a automobile and sign a contract on something they don't own yet and then make us pay for there mistake.

I would need to look at the contract, but it sounds as if they are responsible for delivering a specific vehicle to you. If they do not do so, they are in breach of the contract.

Do not sign anything more. Tell them to deliver the vehicle, or you will file suit.
