Legal Question in Consumer Law in California

Chiropractor wants me to wave my rights with refund check?

My Irenian Chiropractor owed me $185. I reported him and he finally sent me a refund check. I have not cashed it because he sent me a separate letter saying the following: By endorsing this check you are in agreement that no more monies are due to you and that no further collection action will be taken on your paret and that you render me, my office, staff and practice harmless for any further legal or civil action.'' Will I wave my rights by cashing the check? It is my money. Thank you.

So he is Iranian. Is that supposed to be an appeal to prejudice? He owed you $185 and paid you $185. Deposit the check and go to some other chiropractor next time.
