Legal Question in Consumer Law in California

Custom Order Made Incorrectly/Refuse to Remedy

I ordered a custom made dressage saddle from company (The Bridle Path) over the phone. This is standard for saddles. I was told to give them my leg, height, weight measurements, and that the saddle maker (Prestige) would make my saddle to appropriately fit me. After 2 months waiting (prepaid) the saddle arrived with much too long saddle flaps, making it impossible for me to use, and give leg aids to horse without leather prohibiting this. I contacted company several times and was told that custom saddles are not returnable, and it was my problem. I informed them that I had gone on their ''expert'' advice of ordering the saddle to my measurements and not to worry, that ''Prestige new how to correctly determine the size/length.'' I have also contacted the saddle maker (Prestige). I tried to dispute the charge with my credit card company, but since the item was prepaid 60 days prior to it arriving, I could not use this option. I am out $2400.00, with a saddle that is unusable, and I can't even sell it as it would not be appropriate for any riders leg. Please help me if you can. I cannot afford another saddle, and cannot ride in this one.

Re: Custom Order Made Incorrectly/Refuse to Remedy

Your best bet would be to sue the company in small claims court.
