Damage Caused By Towing Company

We had a machine that was damaged by a towing company when they loaded the machine onto a flatbed trailer. We have pictures from the trucking company that show how the damage occured and a quote for the replacement part from the machine manufacture, but the towing company seems to be ignoring us since we reside in the State of Washington.

The damage total is only $331.60

I finally talked to the owner of the towing company after no results with employees and said he would call back, but has not.

What are my options for getting this resolved?

Send a letter asking that his insurance company contact you. Then provide the insurance company the claim information.

If there was a written contract for the towing see if the contract provides for attorney's fees. If so, send a letter requesting resolution before hiring an attorney. If that does not solve the problem, you may be able to hire an attorney or a collection agency to try to collect the money.

It does not make economic sense to file in small claims court. That would cost you more than the claim to come to court to prove your claim.

In any event send a letter (keeping a copy) requesting payment before proceeding with suit or a collection agency.

File a suit in small claims court.
