Legal Question in Consumer Law in California

Possible Defective Central Heater/Airconditioning Unit

Purchased a new roof mount 'Popular Brand' unit in 2003 for over $4000. In 2006, local company who installed the unit had to replace the ''motherboard' in the unit twice, once due to the fact the new motherboard was defective, the second one corrected the problem for the balance of the season. Now in 2007, the company was out 2-3 weeks ago, again replacing the motherboard, which made the heater work again; however, we are now without heat again this weekend. The problem starts out intermittent, then just breaks completely. Do we have any recourse after spending this money on a new unit with 'Popular Brand Name' or with the installation company. I am getting sick of being cold.

Re: Possible Defective Central Heater/Airconditioning Unit

You have claims against both 'Popular Brand Name' and the installer. You should consult with a local attorney without delay to discuss the facts of your case and the possible claims you can make.

Also, the basic facts of your case appear remarkably similar to one that I am working on at the moment. Please see the entry from 9/1/07 on my website, and if the 'Popular Brand' is the same, call me asap.

In any event, good luck!
