Legal Question in Consumer Law in California

Dispute over towing charges

I had my car towed after an accident. My boyfriend and I specified we wanted the car to be towed to the home of a friend who lived nearby. We specifically made it clear we did not want it to be taken to a tow yard where we would be charged a daily storage fee. We gave him the address where we wanted the vechicle towed. We gave him a number where we could be reached. He never arrived with the vechicle. He never called to tell us status of the vehicle. It took several days for us to find the location of our car. We finally located it at a tow yard. Our contention is that the most we should be charged is the original tow. We want the car to be delivered where we specified. The towing company contends that we must pay storage, cost of original tow and an additional towing charge to have the vehicle moved.

Re: Dispute over towing charges

It all depends upon what the driver of the tow truck ageed to do, not what you told him to do. Your question does not reveal the response by the driver to your instructions. Some tow companies are under contract with the city to take cars ONLY to specified storage yards.
