Legal Question in Consumer Law in California

Harassment Based on Race

I was visiting a major food chain one evening and the waitress that served us made racial remarks towards me. S/he made comments that asians couldn't drive, made fun of the way asians speak and lastly used her fingers to make herself look asian. What blew my mind was that the shift manager allowed this to happen. He was standing right behind the waiter/ress. I felt humiliated. Isn't this harassment?

You should file a complaint with the headquarters of the store. You should also consult with an attorney who specializes in discrimination suits of this type. You have a good case.

Re: Harassment Based on Race

No this is not harassment, it is racial discrimination. (You might consider reposting this in the civil rights category). Racial discrimination should not be tolerated at any business establishment and a manager essentially ratifying such actions by permitting them to occur is not acceptable. The hard question here is, was anyone else with you when this happened to witness these events?
