Legal Question in Consumer Law in California

Mortagage company is holding my insurance funds, unable to repair my home

I have $20,000 in damage from hurricanes. My insurance company sent me repair check. Ameriquest Mortgage company has my check and is holding it, telling me I have to make repairs then they will give me my money. I dont think this is lawful. I am a single mother with four kids with extensive damage. Every time it rains it rains in my house. I have a licensed roofer all set to make repairs and have provided the mortgage company with all the information they have requested. But they still will not release money for repairs. Please tell me what the laws are that mortgage companies must follow to protect consumers from this kind of thing. I need my house fixed and dont know where to turn. I cant afford the repairs on my house without the insurance money and I cant afford an attorney.
