Legal Question in Consumer Law in California

Reimbursement of services not rendered

I signed a contract with a personal trainer for about $1400 for 30 sessions in February 2003. We had 2 sessions completed when I was became ill with a detached retina and was advised i could not continue personal training. When i contacted the trainer in June, i learned he had moved from So. Orange County to San Diego without notification and was not able to fullfil the contract from his side either. When i requested a refund he advised he would do so beginning July. He said he had to pay $100/mo for a couple months and then larger sums to complete. I advised i had medical bills to pay and needed the full amount within 6 months. To date I have received a $50 check in Sept and $100 money order in Oct. I have not cashed either one. I'd like to know what i can do to get my money back.

Re: Reimbursement of services not rendered

sue the trainer in small claims court. Cash the checks you now have.
