Legal Question in Consumer Law in California

undisclosed collision damage

I bought a used 2002 Mitsu Gallant 14 months ago. (It has 86,000 miles on it.)The Carfacts shows only one owner and 4 car auction sells ( in a few months prior to me buying it. ) While getting an estimate for some minor damage, someone else caused, the adjuster found $3,000.00 in front end damage, missing braces, and frame work. Besides the cash, the body shop wants me to pay storage if I don't fix it there. and I have been in a rental car for three weeks. Neither insurance companys are willing to pay anything more than the minor damage and about 10 days of the rental. The used car dealer that sold me the car said I can trade it in on something else, but I still owe $7,200.00. and I don't think I should get in any deeper with them. My car isn't safe to drive and is torn apart, I do not have $3,000 and no one want to pay storage or rental costs. Are there any laws to protect me?

Re: undisclosed collision damage

You can sue for breach of contract. You may also be able to file a complaint with DMV. However, if you bought the car as is, you may have waived any claim. The question would be whether you can prove the car was in this condition when you bought it.
