Legal Question in Consumer Law in California

Wedding photographer refuses to refund

Hello,

I had hired a wedding photographer for a wedding I had to postpone and eventually cancel.

I chose to pay $2,250 in advance by credit card, 10 months before the date. I gave them six months notice of cancellation.

Despite the more then adaquate notice..they still refused to refund the money I paid, and I never recieved the service.

They say their contracts state all fees are nonrefundable, neither the studio nor I have a copy of that contract.

I've surveyed other photographers and the overwhelming response was refund minus deposit.

I have exhausted every avenue to try and get a resonable refund from them and the continue to refuse me. Do you think I have a chance in Small Claims?

Thank you!

Yes. File immediately. If they produce the contract you may have some difficulty but you have no other option. You might also try the better business bureau.
