Legal Question in Credit and Debt Law in California

Bad check

I received a notice from the DA about a bad check, saying that I can participate in the restitution program. This check was passed 3 months ago, and I have been out of the country ever since and was unaware of it. I was in a foreign country and had have surgery and other medical treatment, i just returned les than a week ago. The person that I gave the check to, sent me a certified notice, my husband received it but never opened it. I don't have a problem paying for the check. What can I do? Is there a way to get all this dropped and for me just to pay the person?
