Legal Question in Credit and Debt Law in California

Browbeating me, being disparaging, degrading and disrespectful. Very combative and belittle my situation. we are self employeed and the money hasn't been coming in so we have been late on our payments. Today they demanded a secure promise of payment by the 17th and after talking to my husband set it up and then this person demanded a another secure promise of payment tomarrow before 5pm, post dated for the 31st of the month I told him he only said (A) payment and he said well we need another onebefore the end of the month or we will repo your car. We are 48 days late. The things he said,to me we very upsetting and they are fully aware that I have been very ill and in and out of the hospital for the past year and a half. He even said he didn't believe my reason for being late. This whole thing was very upsetting, stressful and caused a great deal of anxiety.

Well, if he's not using obscene or profane language or using threat of violence against your person or reputation, then there's not a lot you can do, even with the unfortunate behavior you described. Threatening to repo the car is OK if it's within their contractual right to do so (because of your failure to pay on the loan), and if they really intend to do so. If you don't like to deal with them, then hire an attorney to be your representative and then they must communicate only with the attorney. And yes, you could try complaining in writing to the corporate office and the FTC to have them back off.
