Re: Collecting on a promissary note

If the debtor has defaulted on a promissory note, you most certainly have the right to go to court to get a money judgment for the amount due. I specialize in this kind of litigation; please feel free to contact me if you would like to discuss this further.

Re: Collecting on a promissary note

It depends how much the note is for balanced against the value of your attorney's work. If the note is under $7,500, you can go to small claims court.

Re: Collecting on a promissary note

If the debtor is not paying the promissory note, the only real leverage you have is filing a lawsuit and obtaining a judgment. Once you have a judgment, you can do things such as a wage garnishment or bank levy.

My office is in San Diego County and I do a lot of collection work. Feel free to call for complimentary consultation.
