Legal Question in Credit and Debt Law in California

Collection

My car was repossessed. It went to collection. I just got my credit report and it says that the account was ''charged off as bad debt.'' Can they still collect the debt? I have a attorney that is trying to collect I was just wondering if they could.

Re: Collection

They will come after you for a "deficiency," but you are not legally obligated to pay unless they complied with the law. Consult an attorney in your locality who is familiar with auto repossession law.

Re: Collection

They can still try to collect, and can still obtain a judgment against you for their deficiency, as long as they do so within the period of the statute of limitations (normally four years on a written contract).
