Legal Question in Credit and Debt Law in California

collection debt filed against spouse in Sacramento, CA court

My husband is employed, yet a judgement against my husband has been filed requesting the court to support garnishing my wages. My husband called to make settle the debt and was told they did not want to talk to him, but would continue to pursuit the claim to garnish my wages. My husband was told until the debt is paid in full, between the 1st of January through to the court date January 25, the attorney was charging $100 per hour in addition to the amount claimed. Is this possible? What legal recourse do I have? If we go to court, would the judge award the attorney anymore fees that already on the filed petition?

You should talk to an attorney immediately. You may be able to work something out, consider bankruptcy, or fight the garnishment of your wages. However, you need an attorney to discuss these issues. You should visit my blog at www.californiadebtblog.com for more information on debt collectors and collection agencies.
