Legal Question in Credit and Debt Law in California

cosigner

I cosigner for someone a couple years ago. About year ago, he paid of the vehicle, but he got a credit card in my name and he haven't paid that off. Now I have a judgment agaist me. He told me he took care of everything. I was told because I signed the credit application, he had the right. But there no where on the credit application, that I signed for a credit card. What can I do or what should I do?

Re: cosigner

From what I gather, the CC company position is that through the financing of the vehicle, your friend was also entitled to a credit card. If that is the case, then a review of the financing agreement would be necessary before seeking to remove the judgment against you. If you feel this CC was opened in your name fraudulently, it should be reported to law enforcement promptly. Feel free to contact me to discuss your options.

Yours truly,
