Legal Question in Credit and Debt Law in California

Out of Court Settlements

I am being taken to court by a creditor and I have 30 days

to file an answer. We have reached a mutual agreement to

settle the matter out of court. Am I still required to pay

the filing fee to answer the court and advise the court of

our agreement? or do I just continue with my agreement with

this cred

Re: Out of Court Settlements

You should get a written statement from the creditor stating what the agreement is, i.e. if you pay a certain amount according to a certain schedule that the case will be dismissed. It should also state that they will not take a default against you if you comply with the terms. If you have that written agreement, you shouldn't need to file answer or pay filing fee.
