Legal Question in Credit and Debt Law in California

If Default is Set Aside Will Money Taken Be Refunded?

I had a default judgment entered against me on a disputed debt. They started garnishing my wages in September and I want to get the default set aside. The soonest I can get a court hearing is November. If I win at the setting aside of the default will the money they have already taken be refunded?

The answer is no, it won't be refunded automatically. You will either need to bring a motion with the Court, file a cross-complaint or try to negotiate a voluntary return of the money.
