Legal Question in Credit and Debt Law in California

dismissal due to settlement

I paid the settlement amount requested by the plaintiff in mid-March. As of yet I do not have a dismissal nor has a request for dismissal been made to the court. I've tried contacted the plaintiff and they will not return my calls/emails/faxes. How long do they have to file the dismissal?

Re: dismissal due to settlement

You can file a Notice of Settlement with the court. The court will set a hearing in about 45-60 days summoning the plaintiff's lawyer to court to explain why the dismissal was not filed. The form could be found on the Judicial Council website.
