Legal Question in Credit and Debt Law in California

government contracted lawyer collecting interest?

HELLO, thank you for taking the time to answer my question.

My friend was contacted by a lawyer located in Texas. The lawyer said he was collecting interest on a loan from 30 years ago.He wants her to start sending payments. We wanted to know if this is possible and make sure it's not a scam.

Thanks again.

Re: government contracted lawyer collecting interest?

Apart from a student loan, the SOL in California is 4 years for such debts. Your friend has no legal obligation to pay such a debt at this point in time, given the latter type of debt. If you would like our Law Firm to affordably send the attorney at issue a cease and desist letter to end the "harassment", contadt us with your request.

If it's not a student loan, she's not obligated to make any payments. In CA, the statute of limitation runs after 4 years following the default if the agreement was in writing, or 2 years if not in writing. The lawyer's calendar is a little off or he's just trying to scare money out of her.
