Legal Question in Credit and Debt Law in California

my husband was served with summons and we agreeed to pay over the phone with the collector but thety have made it impossible for us to keep paying the amount that they want, weve been paying for 8 months but it is putting us in a hardship.. we have not signed the the stipulation of settlement with them because we know we cant keep paying, so what will happen if we quit paying, also they took this aggement over the phone with me, his spouse who isnt on the account there collecting on..

If you don't pay then the lawyer that is handling the lawsuit will get a judgment from the court and they will have to enforce it by garnishing wages, levying bank accounts, putting a lien on the real property you own, etc. If the spouse is not on the account and the lawsuit is against the husband only then the judgment will be against the husband. You might still have time to answer the court complaint and gain some more time to work out some other deal or have the matter go to a trial.
