Legal Question in Credit and Debt Law in California

An individual claiming to be from ACS has called my place of work repeatedly harassing employees and my manager. He has also threatened them. The time that I was there when he called I asked what he was calling about. He said that I owed money to a company, but wouldn't say which and asked if I would make a payment. I stated that I would not give personal information over the phone to someone I do not know he then hung up. That was a few months ago. Since then he has called a few times a week, won't leave a name and hangs up. He has called my cellphone with different names, and it is difficult to understand him. He threatened me and gave me two fake numbers. One of the numbers is no longer in service, the other goes straight to a voicemail box.

I have a history of anxiety issues. Since then, I 've been experiencing panic attacks, insomnia, stomach pain and related issues. I went to the doctor but my abdominal pain was unexplained. I strongly believe that it was related to stress. I am worried that this could cause issues with my place of employment, and I am upset that he is harassing employees.

I wanted to take this company "ACS" (as he claimed to be from their legal company) to court for small claims. I have e-mailed this company, called back the numbers he gave, and nothing. I have filed a complaint with BBB and have not received a response. I plan on sending a certified letter.

However, I want to take this individual/company to small claims. How should I go about this? And what should I put for the claim amount? I can get letters from the individuals he harassed if necessary.

Sounds like you are facing some violations of Fair Debt Collection Act. You can sue but you will need addresses. Complaint with BBB won't go far. They have to stop contacting you directly if you have an attorney. If you owe money see if you can figure it out. It also could be a scam
