Legal Question in Credit and Debt Law in California

I just want my money back!!

Thank for you taking time out to read my case. Here it is:

I made a deal to purchase a piece of equipment for my business. I paid a deposit of $1,500 with the agreement to pay the rest once the equipment proves to be fully operational and functional. Well, I have the equipment here but the person who sold it to me failed to make the machine work. He's agreed to pay me back my money and take back his machine. Well, it's been 9 months and over 100 phone calls and emails and still no resolution. All I have is his cell number and his email. I do not have an address which i can find him. I'd like to take him to small claims court but how do I serve him papers if I can't find him? Is it legal under the law for me to confiscate his machine and sell it myself to reclaim the losses? Any help regarding this matter would be extremely appreciated. Thank you.

It might be worth your while to hire an investigator to find him, assuming his name is not a very common one.
