Legal Question in Credit and Debt Law in California

Obligation to pay annual tuition even when child is not enrolled

In March 2001 we signed a contract to enroll our child into the 1st grade program of a private school. There was wording in the contract that required us to commit to a full year's tuition regardless of when we withdrew our child from the school.

Now we have decided to enroll our child in the local public school and notified the private school, in the week prior to commencement of academic year, that we would not be enrolling out child in their program.

They have come back to us saying that we are still obligated to pay a full year's tuition.

What are our possible alternatives to negotiate with them?

Thank you.

anything can be offered in negotiation but you rights are defined by the wording of the contract. i would tell them you are not going to pay anything but to avoid a fight you would be willing to settle for XX%.
