Paid Off Debt - Not paid off??

We paid our daughter's car loan off with a finance company 10-06-08. When they did not send the title or receipt documents as promised, We contacted them 01-02-09 and they said it went on as prorated payments throught May 2009. My daughter talked to the Legal manager personally in October and she is the one who gave me the amount of $2642.64 to pay the car off. It was paid by the bank on the same date. Now they are asking for more money for late fees to send the title, etc. How can there be late fees on a bill that was completely paid off by a telephone check from our bank and how can they make this amount as future payments when it was a ''Pay off amount?'' This company is definitely not one anyone wants to use. They are located in Anaheim, CA. and give credit to those who have little or bad credit. Nevertheless, the bill was paid in full and why should my daughter have to pay anything more than that? Aren't there laws governing this type of action and shouldn't they send the title when it has been paid off and not try to keep adding on charges?

This is one of those questions that reveals all in the way it is phrased. They "said," you "were told," you "contacted" and "talked to" them. But you never got the payoff amount, or any of their various promises, in writing.

Moral: Don't Do Stuff Orally. Write letters, preferably certified RRR. If you don't know how to write a letter, hire a lawyer.
