Legal Question in Credit and Debt Law in California

past bill

My son went to emergency room 6 1/2 years ago. They coded in level 4 which I disputed. I never got a letter stating the results of dispute. Yesterday I got letter from collection agent saying I owe 656.00. I called hospital and they gave me run around and said I had to pay it. Today they told me I could pay half. I told them I will not pay a all since it has been over 6 years. Do I have to pay it? Even tho I never got a final bill or reason why denied, which I just found out.

The statute of limitations has probably run on this obligation, which means that they cannot file a lawsuit to collect the debt. I'd continue to tell them that you will not pay, and assert the statute of limitations on the debt as your reason. Also threaten that if they continue to attempt to collect an obligation which is no longer valid due to the statute of limitations, you will pursue them in court for violations of the fair debt collection practices act. Check your credit report also, they may be reporting this in which case you can dispute it.

You could be completely right with your analysis. However, it might be more cost effective enter a compromise to pay one-half. Make sure that it's done correctly or the debt collector will attempt to go after the other 50%.

The statute of limitations may have run. We would like to see the letter if you can fax it or e-mail it to us. There may be a violation of the Fair Debt Collecton Act.
