Legal Question in Credit and Debt Law in California

Pension Garnishment

I am 70 yrs old and can no longer work and cannot pay my credit card bills. I receive social security plus a monthly pension from my former employer of 259.60 per month. I know that social security cannot be garnished but can my pension be garnished if I do not pay these bills?

Re: Pension Garnishment

Generally, yes, but if you need that money to pay the necessities of life (food, clothing, shelter) you could file a claim of exemption. You may also want to consult with a bankruptcy attorney.
