Legal Question in Credit and Debt Law in California

Want to take possession of co-signed vehicle.

I co-signed an auto loan for my brother. He has defaulted on the loan and I need to protect my credit. I am a co-owner on the title, written as ''brother AND myself'', as well as the registration.

Question: Are we considered equal as it relates to posession of the vehicle? Do I have a LEGAL right to take the vehicle (reposess) since I am on the title as a co-owner?

Absent any agreement to the contrary, you each have a right to possess the vehicle, so you should be able to take possession provided it can be done without a breach of the peace or trespass.
