Legal Question in Credit and Debt Law in California

Reporting Bankruptcy

The law states that a bankruptcy record must be removed from one's credit report after 10 years from date of filing. Is it legal for a creditor to ask, ''have you ever filed for bankruptcy?'' If I filed for bankruptcy over 10 years ago, how should I answer this question?

Re: Reporting Bankruptcy

Thanks for your inquiry.

A creditor, or someone considering an application for credit, does have the right to ask if you have ever filed bankruptcy. How you answer that question is up to you, but they do have the right to ask it.

Best of luck, and if you have other questions, please feel free to email me at [email protected].
