2nd degree murder

can a lawyer prove 2nd degree murder by a tape that the defendent did not know was being taped. the defendent sarcasticlly statd that he ran someone over, but only after he was asked many times and denying it.s

Talk to your attorney about the admissability of the tape, and the possibility of getting it supressed. If you don't object, it could come in.

the entire tape must be played. it is a piece of evidence that the defendant can refute.
