Legal Question in Criminal Law in California

16 year old accused of molesting his 11 and 7 year old sisters

My nephew has a court hearing on July 2. My brother is taking no action, so therefore I'm seeking instruction on what steps to take for helping him. I surely will be questioned since I received a phone call from the 11 year old and her mother. In that phone call, there was no mention of molestation on her, only the 7 year old. Her complaint was that he was mean to her. She is calling the school and home, harassing my nephew and mother. Her stories keep changing. She now is accusing him of tying her up on the living room for at 9:00 PM and penetrating her and then ejaculating on her face. (I question this because my mother's bedroom is the living room and she's there all the time.)

The 11 year old has gone to a doctor, from what I know he said there was something on her hymen.

I know I'm probably rambling, and I apologize. Please help.

Re: 16 year old accused of molesting his 11 and 7 year old sisters

These are very troubling cases. Considering the young age of the accused and the young age of the victim it can often be very difficult to sort out what is real and actual and what is exageration and fabrication.

A very good way to find the truth is by using an expert to help us explain why and how children will exagerate the facts because of something else that is going on in their life, which is often the case.

The power of a molestation accusation can be overwhelming to the accused. You need to fight back against this horrible prejudice held by society. We can do this by calming down those who will listen and give them some real facts and analysis. When confronted with the realization that if we were accused of such a crime and were also innocent, what kind of jurors would we want and what kind of attorney would we want.

There is hope and real, workable, and effective strategies that can be used to defend the boy against this horrible accusation.

Call if you have any additional questions.
