Legal Question in Criminal Law in California

A 24 year old female was arrested for 4 counts: 2nd degree burglary, possession of a controlled substance, under the influence of a controlled substance, possession of a hypodermic needle. What will likely be the sentence? This is the first time offense (being caught) but drugs/alcohol have been at issue for over a year with several times of various rehab centers, obviously to no avail. Will this come up at the arraignment? This is the state of California.

The ultimate sentence depends on many factors including, but not limited to, quality of legal representation, strength of the evidence against her, defendant's remorse, etc.

I would recommend hiring a qualified lawyer. The felony counts against her (if any) will stay with her for a long time. If you cannot afford an attorney the court can appoint a public defender. This will likely happen at the arraignment.

If I can be of any more help please let me know. I handle criminal cases in Southern California.

Honestly, it is impossible to speculate based upon the scant information you provided. Possible sentence depends on too many factors. Rather than seeking help over the internet I strongly suggest you call a couple or few qualified criminal defense attorneys for a free evaluation of the situation. The person you are describing is facing serious charges and my advice for her and her friends is to do their homework.

Feel free to contact my office.
