Under Arrest

Is it legal to get arrested without the police officer showing you any type of warrant on paper or without him knowing why you are being under arrest?

Re: Under Arrest

that depends. if you were arrested in public, probable cause is all that is needed to make the arrest, however, you definitely have a right to know what the charge is. if you were arrested in your home, then a warrant would be needed to make such an arrest, absent any warrant exceptions that could be applicable. absent these two scenarios, a warrant would be needed or the arrest would be illegal and your case subject to dismissal. feel free to contact us today if you need further assistance.
