Legal Question in Criminal Law in California

Hello,

I was assaulted at a night club by another woman when she thought that I had stolen her sombrero and got a concussion. I am pressing charges against her in criminal court but would like to know what my options are for civil court. This occured in California. The security of the club ran up and helped me within about 6-10 seconds. Please let me know.

You have two options. You can file a civil restraining order against her which would order her to stay away from you, your home, your vehicle and place of business. Information regarding forms and how to file can generally be found on your local court's website.

Your second option is to file a civil suit for personal injury and damages. You are entitled to compensation for your pain and suffering. This includes medical expenses, loss of income and physical and emotional pain and suffering.

If the District Attorney files charges against this person and the person either pleads guilty or is found guilty by a jury then they would be ordered to pay restitution to you. It should be noted that this only includes non-emotional damages, i.e. medical expenses, property damage and loss of income.
