Legal Question in Criminal Law in California

attempted murder

i have 2 sons that are represented by conflict attornys. its a year later and one attorney has never talked to my oldest son who is accused of shooting someone. And my other sons attorny is always present at court and has on several ocassions interviewed him. but is saying that my older son is clearly guilty because of the discription of what he was wearing and he did have a gun when pulled over by the police. my main concern is that the other attorny has only been to court 3 times in a year and they keep postponing the pre-lim and the attorny never returns my calls and has not interviewed his client.what do i do? weve never had any police or legal matters so all of this is new to me .but a year later and no progress is a bit ridiculous dont you think. And by the way my boys are 17 & 18.

First, the age alone cannot really be examined as I do not know the facts. As to the non-communication issue...well seems more than a we bit unusual to not talk to a client??? As 664/187 could be a life sentence your first stops might be a meeting with the conflict panel coordinator, a complaint to the Court...by the client not you...or the State Bar, you can do this one...I do wish you and you sons the best in this terrible situation.

While cases sometimes take a long time, it seems inexcusable that one of the attorneys never interviewed his client and is completely unresponsive. In my experience, lawyers who do not fight for you are not worth retaining. Simple solution is to get another lawyer. You also might be able to get a hearing through the California State Bar to get at least some of your money back.

As I understand the situation, your son is represented by a court appointed attorney. His only option is to request a Marsden hearing. At this hearing your son can tell the judge that his attorney has not met with him. A meeting between the attorney and client is necessary to discuss the facts and the possible defenses available. This may encourage the attorney more diligent in representing your son.
