Legal Question in Criminal Law in California

Auto Purchase

We bought an auto on Ebay and were promised by the seller many times that he was sending the Title. We called and wrote numerous times and we never received the title. I made two payments $1,000 and $2245 to Paypal for the transaction on Ebay. Ebay reimbursed me $1,000 of that money but we still do not have a title. We called the seller again and now he wants the $1,000 back so he can send us the title. What are our rights. We don't want to send him anything back. He has made us wait a year without a title to this vehicle. What are our rights. We can try to get the title through oregon DMV but chances are this guy will just dispute it again with them. We are in California and the seller is in Oregon

You would need to either sue here in California for damages, which you are fully entitled to under the factual circumstances described, or sue in Oregon. Either option is legally viable, but have their pros and cons in deciding on which state. You should retain legal counsel to assist you here, as your case is very promising once venue and jurisdiction are strategically determined.

Check with the Oregon department of motor vehicles to determine whether title to the vehicle is in the seller's name.
